Vibzy provides an online file hosting and video streaming service (the "Service", the “Vibzy”). Vibzy offers access to the components of the Service free of charge.
These Terms of Service are an agreement between you and Vibzy regarding your use of the Service. Vibzy provides the Service subject to these Terms of Service.
It is said that we reserve the sole right at our legal discretion to modify or change the below stated T&C;, at any time, which is offered. You will find that the most current version of the T&C; will supersede any and all previous versions. Furthermore, it is your legal obligation to review and acknowledge both the usage of the Site and T&C; carefully and upon acceptance of all the terms set forth.
Vibzy is a cloud service which provides the users with the convenience of accessing their data from any location and the security of additional back-up for such data.
Vibzy reserves the right to remove any files that compromise the security of the server, use excess bandwidth, or are otherwise malignant.
The following types of files may not be uploaded under any circumstances:
Files that infringe on the copyrights of any entity.
Files that are illegal and/or in violation of any laws.
Pornography or child pornography, sexually explicit postings and/or content;
Promotions dealing with escort services, dating services, illegal goods, illegal drugs and/or actions relating to any terrorist activities;
Materials that illustrate any hatred towards others that may or may not be slanderous, grossly offensive, expressions of prejudice or lewd blatant profanity that involves violence, harassing, bullying and otherwise objectionable content;
Services that result in spamming and/or any pyramid schemes or gambling;
Posts that promote instructions to encourage destructive or illegal actions against any governments, organizations or law enforcement agencies;
Content that introduces the use of any harmful viruses, codes and/or trojan.
Therefore, you agree that you will not violate any of the above provisions or additional provisions from time to time added by Vibzy and hold us liable for any illegal or prohibited content. In case you are found to be in violation of any prohibited content that contradicts our policies and/or even results into any criminal or civil laws violation, you will be subjected to be disbarred and removed from the Site and reported to all local and international authorities within but not limited to the jurisdictions of Vibzy, or any other jurisdiction that considers any cross-border criminal act to be prosecuted. We will not hesitate to provide data and work closely with any authority in the act of good faith to bring justice. You may also contact us in case you consider any activity to be illegal or in any such violation of our policy with prohibited content.
Terms Of Usage
Vibzy assumes no liability for lost or corrupt links, files or misplaced file URLs.
It is user's responsibility to keep track of this information.
You acknowledge and agree that you are solely responsible for the content that you upload, store or share with others using the Service (collectively "User Content"), and for the consequences of uploading, storing or sharing any User Content.
You acknowledge that administrator may terminate your account if you have not logged in your account in a consecutive six month period.
We are governed by the Regulation of Electronic Communications and Posts Law (112(I)/2004 )in all aspects relating to communications by using Vibzy. You hereby agree and consent to these regulations by receiving electronic communications through Vibzy. All notices, disclosures and any other forms are subjected to the requirements and authorizations of electronic communications outline in the above Act of Law.
Spam Policy
We do not allow any spam as acting in compliance with Section 106 of The Regulation of Electronic Communications and Postal Services Law of 2004 (112(I)/2004) that deals with unsolicited communications of spam. Furthermore, Vibzy reserves the legal right to prosecute for this violation, which may result in monetary civil fines, including, but not limited to criminal sanctions.
Privacy Policy
The following use of Vibzy and the Site is subjected to our Statement of Privacy, which informs all users of our data collection practices, which you may review on the Site. We save email addresses to access the Site without any verification, as well as the password of each registered User in order to authorize User access to Vibzy. In addition, we can also automatically collect information on a User’s computer hardware and software, including IP-addresses, type of browser used, domain names, access periods, and the addresses of visited sites. Notifications Users agree to receive informational e-mail messages from Vibzy about important events, their account, files, and capabilities within the limits of the Service. Vibzy has liability to use notifications only to inform about the capabilities and changes of the Service concerning the User without use of advertisement messages via third parties.
Advertising
Advertising served by Vibzy itself or by Vibzy in cooperation with a third party ("Vibzy Advertising") may appear on the Vibzy website or in communications sent by Vibzy. You understand and agree that all revenue resulting from Vibzy Advertising will be paid exclusively to Vibzy, and that you have no right or interest in any such revenue. You understand that Vibzy is not responsible for the textual, visual, technological features or the content of advertisements that appear on the Vibzy website or in Vibzy communications, other than advertisements created and served directly by Vibzy (if any). By using the Service, you agree that Vibzy will not be liable for any Vibzy Advertising that it does not create and serve. Limitation of Warranties or Guarantees and Limitation of Liability

Vibzy EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, AVAILABILITY FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. Vibzy DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE SERVICE OR OF ANY CONTENT MADE AVAILABLE THROUGH THE SERVICE. In particular, and without limitation, Vibzy gives no warranty or guarantee that: (1) the Service will meet your requirements; (2) the Service will be uninterrupted, timely, secure, or error-free; (3) the results that may be obtained from the use of the Service will be accurate or reliable; (4) the quality of any products, services, information or other material obtained by you through the Service will meet your expectations; (5) any errors in the components or contents of the Service will be corrected; or (6) that the Service is free of viruses or other harmful components. YOU UNDERSTAND AND AGREE THAT Vibzy WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, INTEREST OR APPRECIATION, LOSS OF GOODWILL, OR HARM TO REPUTATION, OR FOR ANY INTANGIBLE LOSSES RESULTING FROM THE USE OF OR THE INABILITY TO USE THE SERVICE OR ANY DATA UPLOADED, STORED OR MADE AVAILABLE THROUGH THE SERVICE, WHETHER OR NOT Vibzy HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, YOU UNDERSTAND AND AGREE THAT THE MAXIMUM LIABILITY OF Vibzy ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT PAID BY YOU TO Vibzy, OR OWED BY Vibzy TO YOU, PURSUANT TO THESE TERMS OF SERVICE AND THE OTHER TERMS AND CONDITIONS THEY INCORPORATE. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations on liability and damages set forth above may not apply to you.
Indemnification
You agree to hold harmless and indemnify Vibzy, and its affiliates, officers, directors, employees, agents from and against any third-party claim arising from or in any way related to your use of the Service, including any liability or expense arising from any claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorney's' fees, or other liabilities of any kind. Vibzy will make reasonable efforts to provide you with written notice of any such claim, suit or action, but the failure of Vibzy to provide such notice will not relieve you of these obligations.
